The officers knew that the subject’s license had been revoked for another offense so they did a traffic stop on the vehicle. When they approached the vehicle, the officers could see an open container between the feet of the driver and the passenger was holding an open container. The two subjects were placed under arrest and a search of the vehicle, incident to arrest, produced a pipe that is used in the smoking of marijuana. |
